Privacy Policy

GENERAL INFORMATION

  1. This Privacy Policy sets out the rules for the processing and protection of personal data provided by Customers in connection with their use of the Store operated by the Seller at www.cosma.store and contains information on cookies.
  2. The controller of the Customer’s personal data is Cosma SA with its registered office in Warsaw, ul. Plac Europejski 1/P40, 00-844 Warsaw , e-mail address: info@cosma.store , contact telephone number: +48 22 164 78 91 .
  3. The data administrator informs that he uses cookies and geolocation technology on the Store website.

PURPOSES AND PERIOD OF PERSONAL DATA PROCESSING

The Data Controller will process the Client's personal data only for specific, explicit, and legitimate purposes and will not further process it in a manner incompatible with those purposes. The Client's personal data will be processed for the following purposes:

  1. creating an Account on the website in accordance with the Terms and Conditions pursuant to Article 6 paragraph 1 letter b) of the GDPR for the duration of the Sales Agreement, if an account on the website is not created or after the account is deleted, the data will be archived and not used except for the purpose of pursuing, defending or establishing mutual claims.
  2. conclusion and performance of the Sales Agreement in accordance with the Regulations pursuant to Article 6 paragraph 1 letter b) of the GDPR for the duration of the agreement and until the expiry of the deadlines for pursuing claims,
  3. considering complaints pursuant to Article 6(1)(c) of the GDPR for 1 year after the expiry of the warranty period or settlement of the complaint,
  4. pursuing claims related to the concluded contract pursuant to Article 6(1)(f) of the GDPR, where the legitimate purpose is to collect receivables, until the final conclusion of the proceedings, including enforcement proceedings,
  5. fulfilling public law obligations (e.g. tax obligations) in connection with the conclusion of a service provision agreement in accordance with the Regulations, including archiving settlement documents pursuant to Article 6(1)(c) of the GDPR until the expiry of the limitation period for the tax liability,
  6. marketing and for geolocation purposes for the presentation of personalised advertising – for this purpose, the Customer will be asked to provide additional consent pursuant to Article 6 paragraph 1 letter a) of the GDPR, until the consent is withdrawn, and after the withdrawal only for the purpose of defending against claims (for the limitation period for claims for infringement of personal rights).

RECIPIENTS OF CUSTOMER PERSONAL DATA

The Data Administrator may transfer Customer Data to the following recipients:
  1. entities supporting the Data Controller in the activities conducted on behalf of the Data Controller, in particular suppliers of external systems supporting the activities of the Data Controller.
  2. entities conducting postal or courier activities,
  3. entities enabling the Data Controller to perform remote payment operations,
  4. banks, if necessary to conduct settlements, state authorities or other entities authorized under the law.

CUSTOMER RIGHTS REGARDING PROCESSED DATA

  1. The Customer has the right to access their data and the right to rectify, erase, restrict processing, the right to data portability, the right to object, and the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal (provided that the processing is based on consent). Withdrawal occurs by submitting a declaration to the Data Controller by sending a letter to the Data Controller's registered office address or by sending an e-mail to info@cosma.store. Withdrawal of consent does not affect the lawfulness of processing carried out prior to the withdrawal of consent. In the event of withdrawal of consent, the Data Controller will assess whether it still has grounds for data processing. Further data processing in such a case will be possible to defend against claims (e.g., by demonstrating that the right to withdraw consent has been exercised) and only to the extent necessary for this purpose.
  2. The Customer has the right to lodge a complaint regarding violations of the Store related to the processing of personal data to the supervisory authority, i.e. the President of the Office for Personal Data Protection.
  3. The provision of personal data by the Client is necessary to conclude contracts, settle business transactions, respond to inquiries, and resolve complaints. In all other respects, data submission is voluntary.
  4. Providing personal data is voluntary, however, failure to provide the personal data required to conclude the Sales Agreement as specified in the Terms and Conditions will result in the inability to conclude the Sales Agreement. The process of creating an account and concluding the Sales Agreement is open to any adult person with full legal capacity.
  5. The Seller does not collect or process personal data of minors. If information about a child has been collected without the consent of the person exercising parental authority over the child, please provide us with appropriate information so that we can delete the data.

INFORMATION ABOUT COOKIES

  1. Cookies are small text files sent by a web server and stored on the client side. Default cookie parameters allow only the server that created them to read the information they contain.
  2. Cookies may be used only for the duration of the Customer's visit to the Store or may be used to measure the Customer's interaction with services and content over a certain period of time.
  3. Cookies can be used to:
    1. remembering passwords and logins to the Customer Account,
    2. remembering data in the completed form (automatic form completion),
    3. remembering information and compiling statistical data on how the Store is used,
    4. analysis of time spent in the Store,
    5. remembering the settings and preferences selected by the Customer in the Store.

You can manage (accept or reject new cookies and delete existing ones) cookies using various options in your browser settings, which allow you to enable or disable cookies at any time, either globally or for specific activities. Each browser handles cookies differently; detailed information can be found in your browser's menu.
  5. The Store uses mechanisms of external entities, partners, and advertisers, in particular the social functions of Facebook and Google, which is directly related to the storage of cookies of these entities on the Customers' end device.

FINAL PROVISIONS

  1. The Store may make changes to the Store's Privacy Policy. These changes may be triggered by the development of internet technology, possible changes in personal data protection law, and the Store's development.
